Outcome
The Court orders that: (1) The appeal is upheld. (2) Development Application DA460/2025/1 for the demolition of the existing dwelling house and the construction of a new four storey plus attic residential flat building above basement parking levels with landscaping works at 41 Spencer Street, Rose Bay NSW 2029 is determined by the grant of consent subject to conditions contained in Annexure ‘A’. (3) The Applicant is to pay the Respondent’s costs thrown away under s 8.15(3) of the Environmental Planning and Assessment Act 1979 (NSW) in the amount of $12,500.00 within 28 days of the making of these orders.
