Outcome
The Court orders that: (1) The appeal is upheld. (2) Development Application DA/1052/2025, as amended, for the demolition of existing structures, site preparations and tree removal to enable the construction of a five storey residential flat building comprising eight apartments, a communal area, above two levels of basement including 13 car parking spaces, bicycle and motorcycle parking, and associated ancillary site and landscaping works at 29 Stanley Street, Randwick, is determined by the grant of consent subject to the conditions set out in Annexure A. (3) The applicant shall pay the respondent’s costs thrown away by reason of the amendment of their development application, pursuant to s 8.15(3) of the Environmental Planning and Assessment Act 1979 (NSW) in the agreed sum of $10,000 within 21 days of the date of these orders.
