Prior to the issue of any Construction Certificate, the Accredited Certifier and Council's Compliance Team shall be advised in writing of the appointment of a suitably qualified contaminated land consultant to undertake the required investigations and site validation. The suitably qualified consultant must be a Certified Environmental Practitioner under the Environment Institute of Australia and New Zealand (EIANZ) scheme or a Soil Scientist, Certified as a Professional Soil Scientist Contaminated Site Assessment and Management (CPSS CSAM), by the NSW EPA. 4. A Site Environmental Management Plan (SEMP) must be prepared for the site in accordance with Section 9 Site Management Plan for Remediation Works contained in Remediation Action Plan (RAP), dated 28 February 2025 Ref: E35551PTrpt6Rev1. The SEMP must be submitted to Council's Compliance Team and Accredited Certifier prior to any demolition works. 76. Prior to the issue of an Occupation Certificate, the Accredited Certifier and Council’s Environmental Health Officer shall be provided with a Site Audit Statement (Section A Site Audit Statement) issued under the Contaminated Land Management Act 1997, specifying that the site is suitable for the proposed mixed use development. 75. A final fire safety certificate prepared in accordance with Part 11 of the Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021 must be issued by or on behalf of the owner. Copies of both the final fire safety certificate and the fire safety schedule must be (1) supplied to Council, (2) forwarded to the Fire Commissioner and (3) prominently displayed in the building. 56. To ensure that siting, height and view loss objectives are achieved, all wall locations, finished floor levels and ridge levels shall be in accordance with that approved under this consent. NB – The Principal Certifying Authority may require a compliance certificate from a registered surveyor prior to the pouring of a concrete floor or the fixing of roof cladding to verify compliance. 24. Prior to the commencement of any works the appointed principal certifier shall be provided with a Site Audit Statement (Section B Site Audit Statement) issued under the Contaminated Land Management Act 1997, specifying that the site is suitable for its intended use. 22. Prior to the issue of any Construction Certificate, the Accredited Certifier and Council’s Compliance Team shall be advised in writing of the appointment of a site auditor, accredited in accordance with Part 4 of the Contaminated Land Management Act 1997. 3. The temporary demountable buildings on 49B The Esplanade, Mosman shall be removed and the site made good to the condition of the Tennis Court at the date of this application, 6 months after obtaining an Occupation Certificate for the works that are the subject of this development application. 21. Materials and finishes shall be complementary to the character and streetscape of the area. Highly reflective roofing materials shall not be used.
